DMCA Copyright Policy

Hands To Home respects the intellectual-property rights of others and responds to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). This page explains how to send a takedown notice, how a seller can file a counter-notice, and our repeat-infringer policy.

Designated Copyright Agent

Send copyright takedown notices and counter-notices to our designated agent at [email protected]. Notices must include all of the elements listed below; incomplete notices may not be actionable.

Submitting a Takedown Notice

To report infringement, your written notice must include (17 U.S.C. § 512(c)(3)):

  1. your full name, mailing address, telephone number and email address;
  2. identification of the copyrighted work you claim has been infringed;
  3. identification of the listing or material you claim is infringing, with the product URL(s) so we can locate it;
  4. a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law;
  5. a statement that the information in your notice is accurate, and — under penalty of perjury — that you are the owner or authorised to act on the owner’s behalf;
  6. your physical or electronic signature.

On receipt of a valid notice we will promptly remove or disable access to the identified listing and notify the seller.

Filing a Counter-Notice

If you are a seller whose listing was removed and you believe it was a mistake or misidentification, you may send a counter-notice to the agent above containing (17 U.S.C. § 512(g)):

  1. your name, address, phone and email;
  2. identification of the removed material and the location where it appeared;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. consent to the jurisdiction of the federal court for your district (or, if outside the U.S., a district in which we may be found) and to accept service of process from the complainant;
  5. your physical or electronic signature.

If the original complainant does not file a court action within 10–14 business days, we may restore the listing.

Repeat-Infringer Policy

In accordance with 17 U.S.C. § 512(i), we maintain a policy of terminating, in appropriate circumstances, the accounts of sellers who are repeat infringers. Every seller accepts this when they agree to the Seller Agreement.

Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing — or was removed by mistake — may be liable for damages. Please make your notices carefully and in good faith.
